The latest court ruling out of Delaware is a reminder of why the misapplication of the public nuisance doctrine is bad for business and consumers. A judge dismissed a lawsuit brought by Delaware’s attorney general against two companies over PCB Pollution, reaffirming the legal holding that public nuisance law isn’t applicable to the sale of legal products.
